The short version. Everi-Circle is a private space where a small group plans something real together — a wedding, a burial, a birthday, a trip, a project. You need an account and you must be 13 or older. What you post stays yours; you give us only the permission we need to show it to your circle.
We are not a bank and not a payment processor. The money features keep a record of who paid what. The money itself moves between you and other members through your own bank or wallet app. We never hold it and we charge no fee.
Be decent to the other people in your circles. If you are not, we will remove content and close accounts.
1. This agreement
These Terms are a contract between you and Everi-Circle ("we", "us"). They cover the Everi-Circle mobile app and our website. By creating an account, or by using the app at all, you accept them. If you do not accept them, do not use Everi-Circle.
Our Privacy Policy forms part of this agreement and explains what we do with your data.
2. Who may use Everi-Circle
- You must be at least 13 years old.
- If you are in Nigeria and under 18, you need a parent's or guardian's consent, because the Nigeria Data Protection Act 2023 treats under-18s as children.
- You must be 18 or older to use the money features — to add a payment handle, create a payment request, or record a contribution.
- You must be able to form a binding contract, and not be barred from using the service under any applicable law or sanctions list.
- One person, one account. Do not create an account for someone else or pretend to be someone you are not.
3. Your account
- Give accurate information when you sign up and keep it current.
- Keep your password and your device secure. Everything done through your account is treated as done by you.
- Tell us at support@evericircle.com immediately if you think someone else has got into your account.
- You can delete your account at any time from Settings → Delete account, or from our deletion page. Section 12 explains what happens when you do.
4. Circles, roles and invitations
A circle is a private group. Whoever creates a circle is its organiser; everyone else is a member. Organisers can change a circle's settings, manage which tabs are on, invite and remove people, and manage payment requests. Membership is by invitation only — a share link the organiser sends you.
Anything you post inside a circle is visible to every member of that circle. Treat a circle as semi-public: once other people can see something, you cannot un-see it for them, even if you later delete it.
Organisers should invite only people who are meant to be there, and should remove people who no longer belong. We may act on reports about a circle, including closing it.
5. Your content
You keep ownership of everything you post — your photos, videos, posts, comments, lists, events and messages. We do not claim it and we do not sell it.
To run the service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, reformat and display your content, strictly for the purpose of operating and supporting Everi-Circle and only to the people you shared it with. This licence exists so that our servers can legally store your photo and show it to your circle. It ends when you delete the content or your account, except for copies that remain in backups for a short period (see the Privacy Policy) and copies other members lawfully saved to their own devices.
You are responsible for what you post. By posting it you confirm you have the right to, and that it does not infringe anyone else's rights.
You also confirm that where you post photos or videos of other people, you have their agreement to do so — particularly at weddings, funerals and family events.
6. Acceptable use
Do not post, send, upload or do any of the following on Everi-Circle:
- Sexual content involving minors, in any form. This is reported to the authorities and results in a permanent ban with no appeal.
- Harassment, bullying, stalking, threats, or targeting someone with abuse.
- Hate speech, or content attacking people on the basis of ethnicity, religion, nationality, gender, sexual orientation, disability or any similar characteristic.
- Content that incites, promotes or glorifies violence, terrorism or self-harm.
- Pornography and sexually explicit content.
- Sharing someone's private information without their permission — home address, phone number, bank details, identity documents, private images.
- Fraud, scams, phishing, pyramid or Ponzi schemes, fake payment claims, or any attempt to get money from members under false pretences.
- Impersonating another person, or misrepresenting your connection with a person or organisation.
- Spam, bulk unsolicited messaging, or advertising unrelated to the circle.
- Illegal goods and services, including drugs, weapons, counterfeit goods and stolen data.
- Malware, or content that damages or interferes with anyone's device.
- Reverse engineering, scraping, automated access, probing our security, circumventing our access controls, or attacking our infrastructure.
- Using Everi-Circle to break any law that applies to you, including Nigerian and United States law.
7. Money features — what they are and what they are not
Everi-Circle is not a bank, a payment processor, a money transmitter, an escrow agent or a payment service provider. We do not hold, transmit, or take custody of anyone's money, and we charge no fee on any amount recorded in the app.
Everything the Money tab does is bookkeeping: an organiser records what a shared cost is and what each person's share is; a member records that they have paid; the organiser confirms it. The money itself moves outside Everi-Circle, directly between you and the other person, through your own bank transfer, OPay, PalmPay, Cash App, Venmo or whatever the two of you agree.
What follows from that:
- The transfer is between you and the other member. Any dispute about whether money was sent, received or is owed is between you and them. We can show you the record; we cannot reverse a transfer, we cannot issue a refund, and we cannot recover funds.
- A "paid" mark in the app is a claim, not a guarantee. An organiser confirming a payment is confirming what they believe; it does not make us responsible for the money.
- Check the destination before you send. Confirm a payout account or handle with the organiser through a channel other than the app if a large amount is involved. We are not liable for money sent to the wrong destination.
- Your bank or wallet provider's terms govern the transfer itself, including their fees, limits and any charges such as stamp duty.
- No fundraising from the public. The money features are for splitting real costs among people who know each other in a private circle — not for public fundraising, lending, investment schemes, or collecting money from strangers.
- Taxes are yours. If money you receive is taxable where you live, reporting and paying that tax is your responsibility.
- We keep money records for 7 years for legal and tax record-keeping, even after you delete your account. See the Privacy Policy, section 6.
Everi-Circle is free. There is no paid tier, no subscription and no in-app purchase in this version. If we ever introduce one, we will tell you before it applies to you and it will use the app store's own billing.
8. Reporting, blocking and moderation
Everi-Circle carries content created by other people, and we take that seriously.
- Report — every post, comment, moment and direct message has a report control. Tell us what is wrong and we will look at it.
- Block — you can block any member from their profile or from a post. Once blocked, you will not see their content and they cannot message you.
- Leave — you can leave any circle at any time.
We review reports of objectionable content and take action within 24 hours of receiving them. Depending on what we find, we may remove the content, warn the account, suspend it, remove it from a circle, close a circle, or permanently ban the account and the person behind it. Content that sexually exploits a child is removed immediately and referred to the appropriate authorities.
We do not pre-screen everything posted, and we are not obliged to. We may remove content we reasonably believe breaks these Terms or the law, with or without a report.
If you think we got a moderation decision wrong, reply to the notice we sent you, or write to support@evericircle.com. We will review it once more.
9. Our intellectual property
The Everi-Circle app, its name, logo, design and software are ours (or our licensors'). These Terms give you a personal, limited, revocable, non-transferable licence to use the app as it is intended, on a device you own or control. You may not copy, sell, sublicense, or make derivative works from it, and you may not use our name or logo without written permission.
If you send us feedback or a suggestion, we may use it freely, without owing you anything for it.
10. Third parties
The app links out to services we do not control — bank and wallet apps, the app stores, and any website another member shares. We are not responsible for those services, their content or their terms. Where a link opens another app on your phone, what happens there is between you and that provider.
Our own service providers (Google Firebase, Sentry, Expo) are listed in the Privacy Policy.
11. Availability and changes to the service
We work to keep Everi-Circle running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features. If we discontinue the service entirely, we will give you reasonable notice and a way to retrieve your content first.
We may update these Terms. Where a change materially affects your rights we will notify you in the app or by email before it takes effect, and the effective date at the top will change. Continuing to use Everi-Circle after that date means you accept the updated Terms; if you do not, delete your account.
12. Ending this agreement
By you
Delete your account whenever you like — Settings → Delete account, or our deletion page. Deletion is not reversible.
By us
We may suspend or close your account if you break these Terms, if we are required to by law, or if keeping the account open would create a serious risk to other users or to us. Except where a serious or unlawful breach makes it inappropriate, we will tell you why and give you a chance to respond.
What survives
Sections 5 (as to content others lawfully retain), 7 (money records), 9, 13, 14, 15 and 16 survive the end of this agreement, along with the 7-year retention described in the Privacy Policy.
13. Disclaimers
To the fullest extent the law allows, Everi-Circle is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the app will meet your needs, be uninterrupted, be free of errors, or that content posted by other members is accurate, lawful or trustworthy. We are not responsible for the conduct of other members, online or offline, or for any payment made between members.
Some jurisdictions do not allow certain disclaimers. Where that is so, they do not apply to you, and nothing here removes a right you have under mandatory consumer law.
14. Limitation of liability
To the fullest extent the law allows, Everi-Circle and its officers, employees and contractors are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the service.
Because Everi-Circle is provided free of charge, our total aggregate liability to you for all claims arising out of or relating to the service is limited to the greater of the amount you have paid us (which is zero) or ₦50,000 / US$50.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
15. Indemnity
You agree to indemnify and hold Everi-Circle harmless from any claim, loss or expense (including reasonable legal fees) arising out of content you post, your use of the service, your breach of these Terms, or your dealings — including money dealings — with other members.
16. Governing law and disputes
These Terms are governed by the laws of the Federal Republic of Nigeria, and you and we submit to the exclusive jurisdiction of the courts of Lagos State, Nigeria, without regard to conflict-of-law rules.
If you are a user in the United States: nothing above deprives you of the protection of the mandatory consumer laws of the state where you live, and you may bring a claim in the courts of your home state instead if the law of that state gives you that right and Nigerian jurisdiction would deny you a remedy. Both of us keep the right to bring a claim in small-claims court where it qualifies. We do not require arbitration and we do not ask you to give up a jury trial.
The same applies to users elsewhere: where the mandatory consumer law of your country of residence gives you a right that this section would take away, that law prevails to the extent of the conflict.
Before starting formal proceedings, please write to support@evericircle.com and give us 30 days to resolve it. Most things are fixable that way.
17. General
- Whole agreement. These Terms and the Privacy Policy are the entire agreement between us about Everi-Circle.
- Severability. If a court finds part of these Terms unenforceable, the rest stays in force.
- No waiver. If we do not enforce something immediately, we have not given up the right to enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor in a merger or acquisition, on notice to you.
- Apple and Google. Where you obtained the app from the App Store or Google Play, that store is not a party to these Terms and has no obligation to support the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Language. These Terms are written in English; an English version governs.
